Vermont State Police say they arrested a man after another man was seriously injured Thursday afternoon in a shooting outside his home in Montgomery.

Robert Morrell, 77, who lives on Highland Springs Road, was charged with aggravated assault with a deadly weapon, police said in a Thursday evening press release.

Police said Morrell and Kevin Temple, 54, were arguing over the maintenance of the private road on which both men live when Morrell allegedly shot Temple once in the torso with a .22-caliber revolver.

Temple was taken by helicopter to University of Vermont Medical Center in Burlington for treatment, police said in a press release. Temple was reported to be in stable condition as of 4 p.m., they said, and he is being treated for “serious but non-life-threatening injuries.”

The shooting took place around 1:30 p.m. near 128 Highland Springs Road, according to the release. Morrell did not leave the scene, police said.

Morrell was set to be released on a citation to appear for arraignment Friday at the Vermont Superior Court in St. Albans, according to police.
