    The state’s argument here is false. It’s not a question of VY not getting the CPG it wanted. It’s a question of the state changing the rules of the game and NOT EVEN ALLOWING the Public Service Board to go forward with the CPG process.

    In the 2002 Memorandum of Understanding signed by the state, VY agreed to be regulated by the Public Service Board. In 2010, aspiring Governor Shumlin orchestrated a Vt. state senate vote (the “disguised safety vote”) disallowing the Public Safety Board from ever deciding whether or not to issue a CPG to VY.

    Them aint the rules VY agreed to in 2002.

    Really? Is that the best that Louisiana Entergy Yankee can do? Has Murtha stopped guffawing yet?

  3. Entergy’s arrogance continues to amaze. This is a really important case. If Entergy prevails it will establish a precedent of corporate power that is truly frightening. Corporations will be able to do just about anything they want in complete disregard of state and local statutes. It’s not just about Entergy and VY anymore. Entergy’s attorneys have over-reached so far that a favorable ruling on their side could strip states of virtually all authority to regulate corporate behavior. Gone are the days when a state’s corporation commission could withhold or strip a corporation of its license to operate in the state. Now almost every state’s corporation commission does nothing but file papers. Entergy’s case takes a quantum leap forward on the path to absolute corporate power.

  4. Among other things that I think about Entergy is that they are always saying States rights. Now they want the federal government to override the State law. I find it hard to understand why people are against the State of Vermont doing what it feels is the best for the state.

    Mr. Schneider, can you point me to some legal document where Entergy has adopted “Lousiana Entergy Yankee” as its official corporate name?

    Your insistence on name calling is pathetic. It appears even the Shumlin propoaganda team has stopped using that name.
